Furniture Rental Terms and Conditions
These Furniture Rental Terms and Conditions apply to all furniture, décor, accessories, staging items, rental items, delivery services, pickup services, and related services provided by Ottawa Elite Staging, referred to in these Terms as “Ottawa Elite Staging,” “we,” “us,” or “our.”
The customer, purchaser, renter, property owner, real estate agent, stager, business, or individual placing an order through our website, invoice, quote, or any other ordering method is referred to in these Terms as the “Customer,” “Client,” “you,” or “your.”
By placing an order, completing payment through WooCommerce, checking the Terms and Conditions box at checkout, accepting a quote, approving an invoice, accepting delivery, or using any rental items provided by Ottawa Elite Staging, you agree to be legally bound by these Terms and Conditions.
1. Rental Items
Ottawa Elite Staging agrees to rent to the Customer the furniture, décor, artwork, rugs, lamps, accessories, plants, bedding, mattresses, staging props, and any other items included in the order, invoice, quote, delivery record, or rental confirmation, collectively referred to as the “Rental Items.”
All Rental Items remain the sole property of Ottawa Elite Staging at all times. The Customer does not purchase, own, or acquire any ownership rights in the Rental Items unless Ottawa Elite Staging confirms otherwise in writing.
2. Approved Use of Rental Items
Rental Items must be used only in a careful, safe, lawful, and reasonable manner.
The Customer must not misuse, damage, alter, move, sell, transfer, lend, sublease, store improperly, expose to unsafe conditions, or use the Rental Items in a way that may cause damage, loss, staining, odour, contamination, theft, or excessive wear.
Ottawa Elite Staging reserves the right to refuse, cancel, or end a rental if we believe the Rental Items are being used in an unsafe, improper, unauthorized, or damaging manner.
3. Rental Term
The rental term begins on the delivery date, pickup date, installation date, or the date the Rental Items are made available to the Customer, whichever applies.
The rental term continues for the period selected at checkout, shown on the invoice, stated in the quote, or otherwise agreed to in writing.
If the Rental Items are not returned, available for pickup, or picked up by the agreed date, the rental may automatically extend, and additional rental fees may apply.
The Customer remains responsible for the Rental Items and all related charges until Ottawa Elite Staging has collected, received, and inspected all Rental Items.
4. Orders, Quotes, and Availability
All orders, quotes, and product availability are subject to confirmation by Ottawa Elite Staging.
Inventory availability is not guaranteed until the order is confirmed and any required payment has been received.
Ottawa Elite Staging may substitute Rental Items with similar items of comparable style, size, function, or quality if the originally selected items are unavailable, damaged, delayed, discontinued, or otherwise unsuitable.
Photos shown on the website are for general reference. Actual items may vary slightly in colour, size, condition, texture, brand, finish, or appearance.
5. Payment
The Customer agrees to pay all amounts shown at checkout, on invoices, quotes, order confirmations, rental agreements, or other written communications, plus all applicable taxes and additional charges.
Unless otherwise agreed in writing, full payment is due before delivery, pickup, installation, or release of Rental Items.
Ottawa Elite Staging may refuse delivery, pickup, installation, rental extension, or any further service until all outstanding amounts are paid.
All payments are non-refundable unless Ottawa Elite Staging agrees otherwise in writing.
6. Payment Authorization
By placing an order, the Customer authorizes Ottawa Elite Staging to charge the payment method provided for all amounts owing, including rental fees, delivery fees, pickup fees, renewal fees, late fees, damage charges, cleaning fees, replacement costs, missing item charges, administrative fees, storage fees, collection costs, and applicable taxes.
This payment authorization continues after the rental term ends for any outstanding amounts related to the rental.
7. Cancellations, Changes, and Refunds
Cancellation requests must be provided in writing.
If the Customer cancels an order after it has been placed, Ottawa Elite Staging may charge cancellation fees, restocking fees, administrative fees, labour fees, delivery preparation fees, design preparation fees, or any other costs already incurred.
If the Customer cancels close to the scheduled delivery, pickup, or installation date, Ottawa Elite Staging may retain some or all amounts paid.
Changes to an order, rental dates, delivery address, pickup address, delivery time, Rental Items, or service scope are subject to availability and may result in additional charges.
8. Delivery and Access
The Customer is responsible for ensuring safe, clear, legal, and timely access to the delivery location.
Before delivery, the Customer must provide Ottawa Elite Staging with all relevant access information, including parking instructions, elevator reservations, loading dock access, lockbox codes, entry codes, building rules, stair access, restricted delivery times, security instructions, pet information, and any other details that may affect delivery or installation.
If Ottawa Elite Staging is delayed or unable to access the property, the Customer may be charged additional fees for waiting time, rescheduling, extra labour, parking, tickets, storage, redelivery, or any other related costs.
The Customer is responsible for any parking tickets, towing fees, building fines, elevator booking charges, loading dock charges, concierge fees, or other costs caused by incomplete, incorrect, or missing access instructions.
9. Property Condition
The Customer must ensure the property is clean, safe, accessible, and suitable for delivery, pickup, installation, or removal.
The property must be free of construction debris, excessive dust, wet paint, active renovations, exposed nails, unsafe flooring, pests, odours, leaks, moisture, snow, ice, blocked pathways, or any other condition that may damage Rental Items or create a safety risk.
Ottawa Elite Staging may refuse to deliver, install, move, or remove Rental Items if the property is unsafe, unsuitable, inaccessible, or not ready. In that case, the Customer remains responsible for all applicable fees, including delivery, labour, rescheduling, storage, and rental charges.
10. Inspection and Acceptance
The Customer must inspect the Rental Items within 24 hours of delivery or receipt.
If the Customer does not provide written notice of any issue within that period, the Rental Items will be deemed accepted in good condition.
Ottawa Elite Staging may inspect the Rental Items at any reasonable time during the rental term upon reasonable notice.
11. Care of Rental Items
The Customer is responsible for the care, protection, and safekeeping of all Rental Items from the time they are delivered, picked up, installed, or otherwise made available until they are returned to or collected by Ottawa Elite Staging.
The Customer must protect all Rental Items from damage, misuse, theft, loss, weather, moisture, pets, children, contractors, cleaners, trades, movers, guests, buyers, tenants, real estate agents, photographers, videographers, visitors, and any other person who accesses the location where the Rental Items are kept.
The Customer is responsible for all damage, loss, theft, stains, odours, missing items, breakage, excessive wear, or misuse occurring during the rental term, regardless of who caused it.
12. Prohibited Activities
The Customer must not:
- Move Rental Items from the approved delivery or rental location without written approval.
- Sell, transfer, sublease, lend, pledge, dispose of, or give the Rental Items to anyone else.
- Alter, paint, stain, repair, clean, tape, glue, nail, staple, drill, or modify any Rental Items.
- Remove tags, labels, protective coverings, packaging, mattress covers, or inventory identifiers.
- Expose Rental Items to smoke, cannabis, vaping, pets, food, drinks, chemicals, fire, water, moisture, outdoor weather, excessive sunlight, construction work, or unsafe conditions.
- Allow contractors, movers, cleaners, painters, children, pets, visitors, or third parties to misuse or damage Rental Items.
- Use Rental Items for any unlawful, unsafe, abusive, reckless, or unauthorized purpose.
13. Smoking, Vaping, Cannabis, and Odours
Smoking, vaping, cannabis use, incense, strong cooking odours, chemical odours, pet odours, or any other odour-producing activity is not permitted near Rental Items.
If Rental Items are exposed to smoke, cannabis, vaping, odours, or similar contamination, the Customer is responsible for all cleaning, deodorizing, repair, replacement, transport, storage, and loss-of-use costs.
If an odour cannot be fully removed, Ottawa Elite Staging may charge the full replacement cost of the affected Rental Items.
14. Pets and Animals
Pets and animals must not be allowed near Rental Items unless Ottawa Elite Staging gives prior written approval.
If pets or animals are present at the rental location at any time during the rental term, the Customer must notify Ottawa Elite Staging.
The Customer is responsible for all pet-related cleaning, hair removal, deodorizing, scratches, stains, chewing damage, urine, odour, contamination, and replacement costs.
Ottawa Elite Staging may charge cleaning fees for upholstered items, rugs, bedding, pillows, mattresses, throws, or any other items exposed to pets or animals, even if visible damage is not immediately apparent.
15. Food, Drinks, and Stains
The Customer is responsible for all stains, spills, rings, watermarks, grease, dye transfer, ink, makeup, bodily fluids, food marks, drink marks, paint, dust, mud, or other contamination.
If a stain cannot be fully removed to Ottawa Elite Staging’s satisfaction, the Customer is responsible for the replacement cost of the affected Rental Item.
16. Mattresses, Bedding, Upholstery, and Soft Goods
Mattresses, bedding, pillows, throws, upholstered furniture, rugs, and similar soft goods must be kept clean, dry, protected, and free from stains, odours, pets, smoke, moisture, and contamination.
Protective coverings, mattress covers, and packaging must not be removed unless Ottawa Elite Staging permits it in writing.
If these items are used improperly, stained, contaminated, damaged, exposed to pets, exposed to smoke, or returned with odour, Ottawa Elite Staging may charge cleaning, disposal, or replacement fees.
17. Loss, Theft, and Damage
The Customer is responsible for all Rental Items from the time they are delivered, picked up, installed, or made available until they are returned to or collected by Ottawa Elite Staging.
If any Rental Item is lost, stolen, missing, damaged, destroyed, altered, contaminated, or not returned in acceptable condition, the Customer must pay all applicable costs, including cleaning, repair, replacement, delivery, labour, administration, storage, and loss-of-use charges.
Ottawa Elite Staging will determine whether an item can be cleaned or repaired, or whether replacement is required.
Replacement cost may include the cost to replace the item with the same or similar item, plus shipping, taxes, handling, assembly, disposal, administrative fees, and lost rental income.
18. Pickup and Return
The Customer must ensure the Rental Items are accessible, clean, complete, and ready for pickup at the scheduled time.
If Ottawa Elite Staging cannot access the property, or if the Rental Items are not ready, missing, blocked, moved, unavailable, or not in acceptable condition, the Customer may be charged additional rental fees, waiting fees, labour fees, rescheduling fees, pickup fees, and any other related costs.
The rental term continues until all Rental Items are picked up by Ottawa Elite Staging.
19. Late Return and Extended Rental
If Rental Items are not returned or available for pickup by the agreed date, the rental may automatically extend, and additional rental fees may apply.
The Customer remains responsible for all Rental Items and all related charges until Ottawa Elite Staging has collected, received, and inspected them.
20. Third-Party Access
The Customer acknowledges that Rental Items may be accessed by property owners, real estate agents, buyers, tenants, inspectors, photographers, videographers, cleaners, contractors, movers, guests, visitors, and other third parties.
The Customer is responsible for ensuring that all such persons protect and respect the Rental Items.
Ottawa Elite Staging is not responsible for damage, loss, theft, injury, claims, or disputes caused by or involving third parties who access the property or location where the Rental Items are kept.
21. Contractors, Cleaners, Renovations, and Moving Work
No construction, renovation, painting, repairs, cleaning, moving, or contractor work should occur near Rental Items unless Ottawa Elite Staging gives written approval.
The Customer is responsible for all damage caused by contractors, painters, cleaners, movers, trades, renovation work, dust, paint, tools, ladders, water, chemicals, building materials, or other work performed at the property.
22. Risk of Loss
Risk of loss passes to the Customer once the Rental Items are delivered, picked up, installed, or made available to the Customer.
Risk of loss remains with the Customer until all Rental Items are returned to or collected by Ottawa Elite Staging and inspected.
Ottawa Elite Staging is not responsible for any loss, theft, damage, injury, delay, property damage, personal injury, business loss, sale delay, failed sale, buyer reaction, reduced sale price, insurance issue, or other consequence arising from or related to the Customer’s use, possession, storage, or control of the Rental Items, except to the extent required by law.
23. No Guarantee of Results
Ottawa Elite Staging does not guarantee any particular result from the use of its Rental Items or services.
Ottawa Elite Staging does not guarantee that a property will sell, lease, rent, photograph better, receive more showings, receive offers, sell faster, sell for a higher price, or meet the expectations of buyers, sellers, landlords, tenants, real estate agents, photographers, guests, or any other person.
The Customer remains solely responsible for all property, business, marketing, listing, pricing, negotiation, sale, lease, and rental decisions.
24. Limitation of Liability
To the fullest extent permitted by law, Ottawa Elite Staging, its owners, directors, officers, employees, contractors, agents, representatives, suppliers, and delivery personnel shall not be liable for any indirect, incidental, special, consequential, punitive, or economic damages, including lost profits, loss of sale, loss of lease, lost opportunity, delay, business interruption, property value loss, emotional distress, reputational harm, or claims by third parties.
To the fullest extent permitted by law, Ottawa Elite Staging’s total liability for any claim arising out of or related to an order, rental, Rental Items, delivery, pickup, installation, removal, website purchase, or related service shall not exceed the amount actually paid by the Customer to Ottawa Elite Staging for the specific order giving rise to the claim.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
25. Customer Indemnity
The Customer agrees to indemnify, defend, and hold harmless Ottawa Elite Staging, its owners, directors, officers, employees, contractors, agents, representatives, suppliers, and delivery personnel from and against any and all claims, demands, damages, losses, liabilities, costs, expenses, fines, penalties, legal fees, and proceedings arising out of or related to:
- The Customer’s use, possession, storage, control, or handling of Rental Items.
- Damage to or loss of Rental Items.
- Damage to the property or any third-party property.
- Injury or death to any person.
- Access to the property by agents, contractors, cleaners, movers, buyers, tenants, visitors, or other third parties.
- The Customer’s breach of these Terms.
- Incorrect, incomplete, or misleading information provided by the Customer.
- Unsafe property conditions.
- Pets, smoking, odours, stains, moisture, renovations, or misuse.
- Any act or omission of the Customer or any person allowed into the property by the Customer.
This indemnity continues after the rental ends.
26. Insurance
The Customer is responsible for maintaining appropriate insurance coverage for the property and for any risk related to the possession, use, storage, or control of the Rental Items.
Any insurance maintained by Ottawa Elite Staging does not relieve the Customer of responsibility for damage, loss, theft, misuse, unpaid charges, or breach of these Terms.
27. Default
The Customer is in default if:
- The Customer fails to pay any amount when due.
- The Customer breaches any term of these Terms.
- The Customer fails to provide access for delivery, inspection, or pickup.
- Rental Items are moved, damaged, lost, stolen, misused, or not returned.
- The Customer becomes insolvent, bankrupt, or unable to pay debts.
- Ottawa Elite Staging reasonably believes the Rental Items are at risk.
Upon default, Ottawa Elite Staging may, without limiting any other rights:
- Charge all outstanding amounts immediately.
- Cancel or terminate the rental.
- Recover the Rental Items where legally permitted.
- Charge additional rental, pickup, labour, storage, repair, replacement, legal, collection, and administrative fees.
- Charge the Customer’s payment method on file.
- Pursue any legal or equitable remedy available.
28. Collection Costs
The Customer agrees to pay all costs incurred by Ottawa Elite Staging to collect unpaid amounts or enforce these Terms, including administrative fees, collection agency fees, legal fees, court costs, interest, and disbursements.
29. Ownership
All Rental Items remain the property of Ottawa Elite Staging at all times.
The Customer must not sell, transfer, lend, pledge, encumber, dispose of, or allow any lien, seizure, claim, or security interest to attach to the Rental Items.
The Customer must immediately notify Ottawa Elite Staging if any Rental Item is subject to a claim, lien, seizure, attempted seizure, damage, theft, or risk of loss.
30. No Assignment or Subletting
The Customer may not assign these Terms or sublease, lend, rent, transfer, or provide the Rental Items to any other person or location without prior written approval from Ottawa Elite Staging.
Ottawa Elite Staging may assign these Terms or use subcontractors, delivery providers, installers, movers, designers, or third-party service providers as needed.
31. Photos and Marketing
Unless the Customer objects in writing before delivery or installation, Ottawa Elite Staging may photograph or record the Rental Items and the rented setup and may use those photos or videos for portfolio, marketing, website, social media, advertising, training, internal, and promotional purposes.
Ottawa Elite Staging will make reasonable efforts not to disclose private personal information, security details, or sensitive information in marketing materials.
32. Personal Information
The Customer authorizes Ottawa Elite Staging to collect, use, store, and disclose the Customer’s personal information as reasonably necessary to process orders, accept payments, provide quotes, deliver services, communicate with the Customer, manage rentals, enforce these Terms, recover amounts owing, and work with service providers such as payment processors, delivery providers, contractors, software platforms, accountants, legal advisors, insurers, and collection agencies.
33. Website Orders and Checkout Acceptance
By placing an order through the Ottawa Elite Staging website, checking the Terms and Conditions box at checkout, submitting payment, or completing the WooCommerce checkout process, the Customer confirms that they have read, understood, and accepted these Terms and Conditions.
The Customer agrees that this online acceptance has the same legal effect as signing a written agreement.
34. Website Errors and Product Information
Ottawa Elite Staging makes reasonable efforts to keep website information accurate, but errors may occur.
We reserve the right to correct errors, update product information, cancel orders, refuse orders, adjust availability, or modify rental details if there is a mistake in pricing, description, availability, delivery information, product display, or checkout information.
35. Delays and Force Majeure
Ottawa Elite Staging is not responsible for delays, failures, or inability to perform caused by circumstances beyond its reasonable control, including weather, traffic, road closures, accidents, illness, labour shortages, supplier delays, inventory damage, vehicle issues, building access issues, power outages, acts of God, emergencies, government restrictions, strikes, or other events beyond Ottawa Elite Staging’s control.
36. Safety
Ottawa Elite Staging may refuse to deliver, install, move, or remove Rental Items where conditions are unsafe, unsuitable, illegal, or likely to cause injury or damage.
The Customer is responsible for ensuring safe access, safe flooring, clear walkways, snow and ice removal, working elevators, adequate lighting, and a property free from hazards.
37. Entire Agreement
These Terms and Conditions, together with the applicable website order, quote, invoice, order confirmation, rental confirmation, delivery record, or written approval, form the entire agreement between the Customer and Ottawa Elite Staging regarding the rental and related services.
If there is a conflict between these Terms and a written quote or invoice, the quote or invoice applies only to the specific pricing, dates, and items listed, and these Terms continue to apply to all other matters.
38. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be modified or removed only to the extent necessary, and the remaining terms will continue in full force and effect.
39. No Waiver
If Ottawa Elite Staging does not enforce any right or term immediately, that does not mean Ottawa Elite Staging has waived that right or term. Any waiver must be in writing.
40. Electronic Agreement
The Customer agrees that electronic approval, website checkout acceptance, email approval, text message approval, online form submission, payment, e-signature, or acceptance of delivery may be treated as acceptance of these Terms.
Electronic copies and electronic acceptance shall be treated as originals for all purposes.
41. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
The Customer agrees that any dispute shall be handled in Ontario, unless Ottawa Elite Staging agrees otherwise in writing.
42. Customer Acknowledgement
By placing an order, completing payment, accepting delivery, using the Rental Items, or checking the Terms and Conditions box at checkout, the Customer confirms that they have read, understood, and agreed to these Terms and Conditions.
